Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Zinda Education website at https://zindaeducation.com and the education consultancy services we provide. Please read them carefully, because by creating an account or using our services you agree to be bound by these Terms. These Terms apply to all users, wherever in the world you access our website or services.

1. Who We Are

In these Terms, "Zinda Education", "we", "us" and "our" refer to the operator of this service: Tamil in Russia (a business registered in India) together with Zinda Education (registered in Russia). Personal data collection and payments are handled by the Indian entity (Tamil in Russia). Our registered address is NO-1/415, Pettai road, Mannargudi, Ullikottai-I, Thiruvarur district, Tamil Nadu, Pin 614018.

We are an independent education consultancy that helps students from around the world obtain admission to universities abroad — primarily for MBBS and other programmes in Russia. We are not a university, not a government body, and not an official agent of any government.

2. Acceptance of These Terms

By accessing the website, creating an account, uploading documents, making a payment, or otherwise using our services, you confirm that you have read, understood and agreed to these Terms, together with our Privacy Policy, Refund Policy, Disclaimer and Cookie Policy. If you do not agree with any part of these Terms, please do not use our services.

3. Eligibility

• You must be at least 18 years old to create an account and use our services on your own behalf.
• If the applicant is under 18, a parent or legal guardian must provide consent and must use the service on the minor's behalf. By using the service for a minor, the parent or legal guardian agrees to these Terms and consents to the processing of the minor's personal data as described in our Privacy Policy.
• You must provide true, accurate and complete information about yourself or the applicant you represent.

4. Nature of Our Service

We act as an independent consultancy and facilitator. Our services may include admission guidance, application processing, university selection, obtaining confirmation and offer letters, and visa guidance.

We do not guarantee any outcome. In particular, we do not guarantee:

• admission to any university or programme;
• any scholarship, fee waiver or discount;
• approval of any visa or other government permission; or
• any specific result, timeline or standard of living, teaching or facilities at any university.

Final decisions on admission rest with the universities, and decisions on visas and travel rest with the relevant government authorities. These decisions are outside our control. Please also read our Disclaimer.

5. Your Account

To use certain services you must create an account using your email and password or by signing in with Google. Email verification is required before you can submit an application.

You agree that:

• each account is for one person only, and you will not share, sell or transfer your account;
• the information you provide (full name, email, date of birth, gender, nationality, phone number, residential address and programme of interest) is accurate and kept up to date;
• you will keep your login credentials confidential and secure, and you are responsible for all activity that takes place under your account; and
• you will notify us promptly at zindaeducation@mail.ru if you suspect any unauthorised use of your account.

6. Documents You Submit

As part of the application process you may upload documents such as your academic records (10th and 12th marksheets if you are applying from India, or a high-school leaving certificate if you are applying from another country), an optional UG marksheet, your passport (required for applicants outside India; applicants from India may instead provide a passport or a national ID such as Aadhaar), a passport-size photograph, an HIV test certificate, and payment receipts.

You confirm and warrant that:

• every document you upload is genuine, authentic and unaltered, and belongs to the applicant;
• you have the right to share these documents with us and, where required for admission, with prospective universities;
• you will provide any further documents or information reasonably required by us or by a university or visa authority.

Submitting forged, fake, tampered or misleading documents is strictly prohibited and may result in immediate termination of your account, cancellation of your application, and reporting to the relevant authorities. We are not responsible for any consequence arising from false or inaccurate documents or information that you provide.

7. Fees and Payments

• Our fees are stage-wise service and processing fees. These typically include an application/registration fee, a second payment after the confirmation letter is issued, and a final payment before visa processing.
• Payments are accepted by offline bank transfer only. We do not use any online payment gateway and we do not collect or store your card details or bank-login details.
• You upload proof-of-payment receipts, and our team verifies each payment manually. A stage is treated as begun once we start work for that stage after verifying the corresponding payment.
• Each stage fee pays for the work performed at that stage and is non-refundable once that stage has begun. Full details are set out in our Refund Policy.
• You are responsible for making timely payments at each stage. Delays in payment may delay or halt the processing of your application.

8. Your Obligations

When using our services, you agree to:

• provide only genuine and authentic documents and accurate information;
• meet the eligibility, academic, medical and other requirements set by the chosen university and by the relevant visa authorities;
• make payments on time at each stage;
• respond promptly to reasonable requests for information or documents; and
• comply with all applicable laws and with the rules of the universities and authorities involved.

9. Prohibited Conduct

You agree that you will not:

• upload or submit any false, forged, tampered or fraudulent document or information;
• use the service for any unlawful, fraudulent or harmful purpose;
• impersonate any person or misrepresent your identity or relationship to an applicant;
• create more than one account per person or attempt to access another user's account;
• attempt to gain unauthorised access to, disrupt, damage or interfere with the website, its servers or its security;
• upload viruses, malware or any harmful code;
• copy, scrape, republish or exploit any part of the website or its content without our written permission; or
• use any automated system to access the service in a way that harms it or other users.

10. Intellectual Property

The website and all of its content — including text, graphics, logos, the "Zinda Education" name and branding, page layouts, and software — belong to us or our licensors and are protected by applicable intellectual property laws. You may use the website only for the purpose of accessing our services. You may not copy, modify, distribute, sell or create derivative works from any part of it without our prior written consent. Documents and information that you upload remain yours; you grant us permission to process and share them as described in these Terms and in our Privacy Policy.

11. Third-Party Links and Services

Our website may contain links to, or embedded content from, third-party services (for example, university websites, YouTube videos, Google Maps and other tools). We use third-party service providers to operate our service, and student documents may be shared with prospective universities abroad for the purpose of admission. A backup copy of your uploaded documents is also stored in the operator's Google Drive account, as described in our Privacy Policy. We do not control third-party websites or services and are not responsible for their content, availability, policies or practices. Your use of any third-party service is at your own risk and subject to that party's own terms. Please see our Privacy Policy and Cookie Policy for more on the third parties we use.

12. Disclaimers

Our services and the website are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that the website will be uninterrupted, error-free or secure, or that any particular outcome (admission, scholarship, visa or otherwise) will be achieved. Full details are set out in our Disclaimer, which forms part of these Terms.

13. Limitation of Liability

To the fullest extent permitted by law:

• we are not liable for any decision made by a university, embassy, government body or other authority, including any refusal of admission, scholarship or visa;
• we are not liable for any indirect, incidental, special or consequential loss, or for any loss of opportunity, savings, data or reputation;
• we are not liable for losses arising from false, inaccurate or incomplete information or documents that you provide, or from your failure to meet a university's or authority's requirements or deadlines; and
• our total liability to you for any claim arising out of or in connection with our services will not exceed the total service fees you have actually paid to us for the specific stage giving rise to the claim.

14. Indemnity

You agree to indemnify and hold harmless Zinda Education and its operators, owners, staff and representatives from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms, your submission of false or fraudulent documents or information, your violation of any law, or your misuse of the service.

15. Suspension and Termination

We may suspend or terminate your account and access to our services, with or without notice, if we reasonably believe that you have breached these Terms, submitted fraudulent documents or information, or engaged in any prohibited or unlawful conduct. You may stop using the service and request account closure at any time by contacting us. Termination does not affect any service fees already paid for stages that have begun, which remain non-refundable in accordance with our Refund Policy. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnity and governing law — will continue to apply.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of India. You agree that the courts of Thiruvarur, Tamil Nadu, India will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or our services. This choice of law and jurisdiction applies wherever you access our services from, and does not remove any mandatory rights you may have under the consumer-protection or data-protection laws of your own country. We aim to align our data-handling practices with the India Digital Personal Data Protection Act, 2023 (DPDP Act) where relevant.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, our practices or the law.
